When he did Sling Blade, no one knew jack about who he was offscreen.
After he and Angelina Jolie married, and they started down the slippery slope of allowing the world to think of them as 'Freakshow Couple', there was no turning back. They'll always be 'Freakshow Couple' now. They wore vials of each other's BLOOD. Added to that, when you are an ugly, ugly man married to what many consider to be a very beautiful woman, the impression is one of 'She married him', ie 'he is hers'.
As for winning an oscar, eh. Peter Jackson doesn't have one, so how good could they be?
If they want to give him one, they're probably saving his Oscar for Return Of The King; it would make a nice capstone that makes all three movies look better.
Imagine Fellowship getting a big Oscar, and any of the latter two not.
Though really, my personal stance is that as long as he does RotK well, there is no way the Academy will /not/ be able to avoid giving an oscar to him.
